Terms of Service
These terms are written in plain English. If something's unclear, email us at hello@mascot.sh and we'll sort it out.
Who we are
mascot.sh is a product of Wraxle LLC, a company based in San Diego, California. Our mailing address is 3525 Del Mar Heights Rd, Suite 818, San Diego, CA 92130. When these terms say "mascot," "we," "us," or "our," that's who we're talking about.
When we say "you" or "your," we mean whoever's using the service — whether that's you personally or the business you represent.
What mascot does
mascot is an AI-powered mascot generation service. You describe your business, we generate mascot characters using AI image generation, and you pick the ones you love. From there, you can lock a mascot into your brand kit, get it sized for every platform you use, and access it whenever you need it.
The service runs on the web at mascot.sh and may eventually include mobile apps or other interfaces. Whatever the delivery method, these terms apply.
Creating an account
You sign up with Google — that's the only login option right now. By connecting your Google account, you're giving us permission to use your name and email address to create and manage your mascot account. We don't store your Google password; authentication goes through Google's servers.
You're responsible for keeping your account secure. If someone gets into your account without your permission, let us know right away at hello@mascot.sh.
You need to be at least 18 years old to use mascot. By signing up, you're confirming you meet that requirement.
Subscriptions and payments
Monthly plans
mascot offers monthly subscription plans. Your subscription renews automatically each month until you cancel. Prices are shown on the pricing page and in your account settings. We charge in US dollars.
Payments are processed by Stripe. We don't see or store your credit card number — Stripe handles that. By subscribing, you agree to Stripe's terms of service as well as ours.
One-time purchases
Some things — like individual image packs or add-ons — can be purchased once without a subscription. Those are final at checkout. The 7-day refund policy below applies to subscriptions, not one-time purchases.
Price changes
If we change our subscription price, we'll give you at least 30 days' notice before it affects your billing. You'll always have the option to cancel before the new price kicks in.
Credits
Generating mascot images uses credits. There are two types:
- Lite credits — faster generations, good for browsing options
- Pro credits — higher quality, more detail, better for finals
Credits are allocated monthly based on your plan. They don't roll over — unused credits expire at the end of your billing cycle. We're clear about how many credits each generation uses before you hit generate.
If you run out of credits mid-month, you can purchase add-on packs or wait until your next renewal.
Locking mascots and commercial licensing
When you lock a mascot into your brand kit, you receive a commercial license for that specific mascot character. That license covers:
- Using the mascot in your business marketing, packaging, social media, and website
- Printing it on merchandise you sell
- Including it in advertising — digital or physical
The commercial license is tied to your active subscription or the one-time purchase that granted it. See the cancellation section below for what happens if your subscription ends.
What the license doesn't cover
You can't resell the mascot as a standalone asset, claim you created it yourself without disclosure, or transfer the license to a third party. The license is for your business use.
Unlocked and discarded images
When you generate images and choose not to lock them — either by discarding them or just not selecting them — those images remain our property. We may use them to improve the service, retrain our models, or show examples in our marketing. We won't display discarded images publicly in a way that's tied to your business name without your permission.
Once an image is locked and licensed to you, it's yours to use. We retain the right to use it as an example of what mascot can create, but won't sell that specific image to anyone else.
Content ownership and AI-generated work
You own the business descriptions, prompts, and input you provide. That's your content.
The mascot images are AI-generated. Under current law in most jurisdictions, AI-generated images without meaningful human creative input may not qualify for traditional copyright protection. We don't make promises about whether your mascot images are copyrightable — that depends on how they're created and where you're located.
What we do grant you is a commercial license (as described above) that lets you use locked mascots in your business without worrying about that legal uncertainty from our end.
Refund policy
If you subscribe and decide mascot isn't right for you, email us within 7 days of your first payment at hello@mascot.sh and we'll issue a full refund. No forms, no runaround.
The 7-day guarantee applies to your first subscription payment only. Subsequent monthly charges aren't refundable, but you can cancel anytime and you won't be charged again.
If something went technically wrong — like you got charged twice or a generation failed and ate your credits — that's on us and we'll make it right regardless of timing. Just reach out.
What happens when you cancel
You can cancel your subscription anytime from your account settings. When you cancel, your subscription stays active through the end of the billing period you've already paid for.
After that, your account moves to archive mode. You can still log in and view your locked mascots and brand kit. You won't be able to generate new images or download fresh exports until you resubscribe.
Your data isn't deleted when you cancel. If you want your account fully deleted, email us at hello@mascot.sh.
Acceptable use
mascot is for legitimate business use. Pretty simple. Don't use it to:
- Generate content that's illegal, harassing, or hateful
- Create mascots for fake businesses or to deceive people
- Deliberately generate content that infringes someone else's trademark or copyright
- Reverse engineer or scrape the service
- Resell mascot as if it were your own product
- Do anything that would get your Google account banned, since that's tied to your login
If we find an account is being used against these terms, we'll reach out first when the situation allows it. In clear-cut cases of abuse, we reserve the right to suspend or terminate access without notice.
Limitation of liability
We've built mascot carefully and we want it to work well for your business. That said, we can't promise it'll be perfect or uninterrupted.
To the extent permitted by law, Wraxle LLC's total liability to you for any claim related to mascot is limited to the amount you paid us in the 12 months before the claim. We're not liable for lost profits, lost data, or any indirect damages — even if we knew they were possible.
This limitation applies regardless of whether the claim is based on contract, warranty, tort, or anything else.
Termination
You can stop using mascot and close your account anytime.
We can suspend or terminate your account if you violate these terms, if we're required to by law, or if we decide to shut down the service. If we shut down mascot entirely, we'll give you at least 60 days' notice and won't charge you past your cancellation date.
Changes to these terms
We'll update these terms when our service changes or when legal requirements push us to. If a change is significant, we'll notify you by email at least 14 days before it takes effect. Continuing to use mascot after that date means you accept the updated terms.
The "Effective" date at the top of this page always reflects the most recent version.
Governing law
These terms are governed by the laws of the State of California. If there's a dispute that can't be resolved directly, it'll be handled in the courts of San Diego County, California. Both parties agree to that jurisdiction.
